Після набуття Україною незалежності розпочався повільний процес формування власної нормативно-технічної бази щодо різноманітної продукції та послуг, який “потягнув” за собою і розроблення власних нормативно-правових актів, які б регулювали процеси оцінювання їх відповідності. Що таке оцінка відповідності? Первинним трендом було розроблення здебільшого нормативних документів, які з тих чи інших причин видавалися “зручними” або такими, які можна було реалізувати “малою кров’ю”. Сперечатися на предмет того, добре це було чи погано, вже не є актуальним та доцільним. Так чи інакше, на нашу думку, упродовж цього часу було зроблено ряд важливих кроків уперед. Саме в перші роки після розпаду СРСР було сформовано і відому систему сертифікації УкрСЕПРО, яка значною мірою відрізнялася від існуючих в західних країнах систем сертифікації продукції.
Але життя не стояло на місці, згодом було прийняте рішення щодо гармонізації вітчизняної нормативно-технічної і нормативно-правової бази з відповідними європейськими і міжнародними документами. Дуже хочеться сподіватися, що в Україні й надалі дотримуватимуться цього курсу і що цей процес “набиратиме обертів”, що дасть реальну змогу якомога швидше подолати технологічну відсталість.
Status quo
Останніми роками в Україні було прийнято тисячі міжнародних та європейських стандартів, які дали (принаймні, в теорії) “зелену вулицю” новим для держави технологіям і обладнанню. Водночас, відповідно як до чинних раніше, так і до оновлених нормативно-правових актів, стандарти самі собою не є обов’язковими для виконання нормативами, але посилання на них в окремих видах документів, прийнятих центральними органами державної виконавчої влади, робить їх застосування обов’язковим. До таких нормативних документів належать у тому числі технічні регламенти, будівельні норми, а також нормативно-правові акти щодо охорони праці, здоров’я, пожежної та техногенної безпеки тощо.
У цій статті хотіли б зупинитися саме на таких документах як технічні регламенти. Актуальність тематики підтверджується тим, що система сертифікації УкрСЕПРО фактично доживає свій вік і на заміну їй має прийти система оцінювання відповідності, адаптована до чинних в Європі нормативних документів.
Минуло вже 2 роки від моменту, коли було прийнято Закон України “Про технічні регламенти та оцінку відповідності”, який має стати наріжним каменем для розроблення названих нормативних документів і виконання дій, вказаних у назві Закону. Перша стаття цього нормативно-правового акта містить визначення великої кількості понять, що вживаються в ньому, але в цій статті докладно зупинятися на всіх них ми не будемо.
Обмежимося лише цитуванням визначення одного з термінів, який нас цікавить: “технічний регламент – нормативно-правовий акт, в якому визначено характеристики продукції або пов’язані з ними процеси та методи виробництва, включаючи відповідні процедурні положення, додержання яких є обов’язковим. Він може також включати або виключно стосуватися вимог до термінології, позначень, пакування, маркування чи етикетування в тій мірі, в якій вони застосовуються до продукції, процесу або методу виробництва”.
Відповідно до вище згадуваного Закону, “цілями прийняття технічних регламентів є захист життя та здоров’я людей, тварин і рослин, охорона довкілля та природних ресурсів, забезпечення енергоефективності, захист майна, забезпечення національної безпеки та запобігання підприємницькій практиці, що вводить споживача (користувача) в оману”. Залишається додати, що технічні регламенти розроблюються на основі міжнародних, регіональних (зазвичай європейських), національних стандартів України, інших держав, актів законодавства Європейського Союзу, економічних об’єднань або інших держав чи відповідних частин таких стандартів і актів законодавства. Право прийняття технічних регламентів надано Верховній Раді України, Кабінету Міністрів України, а також центральним органам державної виконавчої влади.
Причинно-наслідковий зв’язок
Згідно з цитованим Законом, відповідність введеної в обіг, наданої на ринку або введеної в експлуатацію в Україні продукції (вживаємо терміни, передбачені ним) вимогам усіх чинних технічних регламентів, які застосовуються до такої продукції, є обов’язковою (за винятком окремих випадків, передбачених цим самим документом). Слід зауважити, що наразі в Україні прийнято вже півсотні технічних регламентів, офіційну інформацію щодо їх переліку можна знайти, наприклад, за такою адресою: http://csm.kiev.ua/index.php?option=com_content&view=article&id=111&Itemid=68&lang=ru.
Легко побачити, що до певної продукції можуть бути застосовні один або більше технічних регламентів, відповідно, існує потреба у підтвердженні її відповідності усім застосовним технічним регламентам. Водночас, відповідно до ст. 25 Закону, “оцінка відповідності вимогам технічних регламентів здійснюється у випадках і шляхом застосування процедур оцінки відповідності, які визначені в таких технічних регламентах”.
Виробники та інші особи, інтереси яких зачіпає він, застосовують процедури оцінки відповідності вимогам технічних регламентів самостійно, а у випадках, визначених у технічних регламентах чи передбачених ними процедурах оцінки відповідності, – із залученням відповідних органів з оцінки відповідності.
Цікавим питанням залишається визначення кола так званих виконавців завдань з оцінки відповідності. До них законодавець відносить:
- – призначені органи, якими є органи із сертифікації та органи з інспектування, а для виконання окремих завдань з оцінки відповідності будівельних виробів – також випробувальні лабораторії;
- – визнані незалежні організації – для виконання визначених завдань з оцінки відповідності технології виконання нерознімних з’єднань, персоналу, який виконує нерознімні з’єднання, та/або персоналу, який проводить неруйнівний контроль, згідно з технічним регламентом щодо обладнання, що працює під тиском; а також
- – акредитовані випробувальні лабораторії виробників – для виконання визначених завдань з випробувань (контролю) продукції, які визначені у деяких процедурах оцінки відповідності, якщо такими процедурами для виробника передбачений вибір щодо звернення до власної акредитованої випробувальної лабораторії або до призначеного органу.
Що буде далі?
Декларування відповідності згідно зі ст. 28 Закону України “Про технічні регламенти та оцінку відповідності” фактично означає, що Ви маєте право сказати “за допомогою моєї вудки можна ловити рибу, сидячи на хмаринці на висоті двох кілометрів” тільки в тому випадку, якщо правдивість цього твердження буде доведено згідно з вимогами цього ж Закону. Іншими словами, вдаватися до послуг установ щойно названих типів так чи інакше доведеться.
На фоні усіх цих подій і загострилися відносини між ДСНС та Мінрегіоном спочатку за розподіл повноважень у сфері ліцензування, а надалі – відбулося поширення і на решту сфер. Чи потрібно казати, що за такого стану справ не буде “нормально почувати себе” ані окремий підприємець чи бізнесмен, ані держава в цілому.
При цьому всьому, є обгрунтовані підстави вважати, що “тягти ковдру на себе” усі ці “титани” будуть і тоді, коли справа дійде до розподілу повноважень у сфері призначення (тобто надання третім особам права виконувати певні завдання з оцінки відповідності), самого призначення і решти процедур, пов’язаних з цими процесами…
До слова, коли вже зайшла мова про ДСНС, то варто розкрити цікавий момент: за інсайдерською інформацією, у надрах зазначеного відомства наразі готується проект технічного регламенту щодо протипожежного обладнання, аналогів якому в європейському законодавстві немає. І хоча повністю не зрозуміло, яким він буде і коли набере чинності, можна очікувати будь-чого. Тому не будемо забігати наперед та коментувати будь-що…
Відмінність України від, скажімо, європейських держав полягає і в тому, що часто-густо відсутні так звані перехідні періоди, упродовж яких ще можна користуватися старим нормативним документом, поступово адаптуючись до нового. Гадаємо, не буде винятком і перехід від підтвердження відповідності (сертифікації) продукції до декларування її відповідності, який вже не за горами. А різкі переходи, як відомо, завжди бувають дуже складними і можуть супроводжуватись різноманітними “втратами”.
Іншими словами, вже незабаром слід очікувати зростання “ентропії”, яка наразі і так надзвичайно висока. Як водиться, багато хто у цей час, імовірно, займеться “ловлею риби в каламутній воді”. Аби Вас не спіткала доля цієї самої рибки, потрібно належним чином підготуватися до майбутньої зміни максимально з усіх фронтів: технічного, документального та юридичного. Навіть поверхневого погляду на Закон України “Про технічні регламенти та оцінку відповідності” достатньо, щоб зрозуміти усю складність ситуації, яка незабаром складеться, а також збагнути, що адаптуватися до нових правил гри без допомоги кваліфікованих спеціалістів навряд чи вдасться.
