Як відомо, одними з перших основоположних державних будівельних норм, прийнятих після набуття Україною незалежності, стали ДБН 360-92 Містобудування. Планування і забудова міських і сільських поселень. Не зважаючи на те, що з моменту їх затвердження до них час від часу вносилися ті чи інші зміни, станом на сьогоднішний день вказані ДБН все одно неповною мірою відповідають сучасній уяві та вимогам сьогодення, а також рівню розвитку технологій будівництва.
Як результат, постало питання щодо розроблення державних будівельних норм на заміну ДБН 360-92; водночас, “під роздачу” потрапили не тільки вони, але й ряд інших нормативних документів щодо будівництва, скажімо так, загальнодержавного рівня. Якщо точніше, то наразі триває процес розроблення державних будівельних норм під назвою “Містобудування. Планування і забудова територій”, якими передбачено замінити ряд нормативних документів, а саме:
– ДБН 360-92 Містобудування. Планування і забудова міських і сільських поселень;
– ДБН Б.2.4-1-94 Планування і забудова сільських поселень;
– ДБН Б.2.4-3-95 Генеральні плани сільськогосподарських підприємств;
– ДБН Б.2.4-4-97 Планування та забудова малих сільськогосподарських підприємств та селянських (фермерських) господарств;
– ДБН Б.1-2-95 Склад, зміст, порядок розроблення, погодження і затвердження комплексних схем транспорту для міст України;
– СНиП ІІ-89-80 Генеральные планы промышленных предприятий.
Передбачувана побудова та принципові відмінності
Процеси розроблення та обговорення проекту будівельних норм з ряду причин тривають давно та йдуть вельми непросто. Спрогнозувати точно, коли новий документ нарешті “побачить світ”, на сьогодні важко, проте описати його передбачувану побудову ми все ж таки насмілимося. Отож, передусім вкажемо ймовірну структуру вказаного документа, яка планує включати у себе такі розділи:
- Сфера застосування.
- Нормативні посилання.
- Терміни та визначення понять.
- Загальні положення.
- Функціонально-планувальна організація територій.
- Планування територій житлової забудови.
- Території громадської забудови.
- Території виробничої забудови.
- Ландшафтно-рекреаційні території.
- Території історико-культурного призначення.
- Транспорт і вулично-дорожня мережа.
- Інженерне забезпечення.
- Інженерна підготовка і захист території.
- Охорона навколишнього природного середовища.
- Протипожежні вимоги.
Інспектування нового будівництва з питань пожежної безпеки
Якщо вести мову про можливі суттєві відмінності майбутнього документа від чинних ДБН 360-92 Планування і забудова міських і сільських поселень (хоча таке порівняння й не зовсім коректне), то їх можна охарактеризувати таким чином:
– п. 7.26 – встановлено зони, що обмежують містобудівну діяльність;
– п. п. 3.7, 3.8, табл. 2.1, 3.2 – визначено показники щільності житлового фонду планувальних утворень;
– п. 5.2, табл. 5.1 – визначено межу ландшафтно-рекреаційних територій як у межах населених пунктів, так і за їх межами;
– п. п. 11.4, 11.10, табл. 11.1, 11.1 – розширене питання збереження традиційного характеру середовища історичних населених місць та реконструкції історичної забудови;
– розділ 4 – зроблено акцент на інноваційний розвиток виробничих територій;
– п. 7.32, табл. 7.1 – удосконалено систему велосипедного руху, забезпечення доступності маломобільних груп населення;
– розділ 3, табл. 3.2 – встановлено показники потреб у сельбищних територіях та граничних параметрів зон житлової забудови;
– розділ 10 – деталізовано складову оцінки екологічних умов у містобудівному проектуванні;
– додаток 3.1 – розширено та деталізовано зміст розділу, присвяченого протипожежним вимогам;
– п. п. 10.33, 10.33 – розвинуто складову санітарного очищення території населених пунктів та поводження з твердими побутовими відходами з урахуванням сучасних технологічних можливостей.
Наостанок
Для чого ми про все це говоримо зараз, якщо цей документ на сьогоднішній день – просто черговий проект будівельних норм, спитаєте ви. Проте варто наголосити, що насправді не все так просто, і тяганина з прийняттям вказаних норм є однією зі складових тих труднощів та невизначеностей, що наразі мають місце в цілому. Адже ні для кого не секрет, що оновлену процедуру погодження вимушених (обґрунтованих, як їх ще іменують) відхилень від вимог будівельних норм, які не можуть не виникати в умовах сучасності, так і не затверджено.
Необхідність такого оновлення зумовлена тим, що незважаючи на те, що такі відхилення дійсно мають бути вимушеними і виступати скоріше як винятки із загального правила, положення існуючої процедури призвели до фактичного зловживання її використанням у випадках, які ажніяк не можна назвати винятковими. Цьому, на нашу думку, сильно посприяло у своїй мірі і скасування вимог щодо порядку розгляду так званих компенсаційних заходів, які зазвичай розроблюються з метою “нівелювання” цих самих відхилень від вимог будівельних норм.
Інспектування робіт з монтажу систем протипожежного захисту
“Дерегуляція”, “зниження тиску на бізнес” тощо – це, безперечно, те, що є неминучим на шляху до цивілізованого суспільства. З іншої сторони, некоректно ставити знак тотожної рівності (що, на жаль, часто-густо намагаються зробити) між демократією та анархією. Варто лише згадати випадки, що сталися нещодавно в Одесі, під Калинівкою, трохи раніше під Васильковим тощо. Корінь зла в усіх випадках – це безконтрольність і нехтування нормами. Це не може не заважати спати небайдужим людям, яких, на щастя, в Україні все ще немало.
Тому при розробці нових державних будівельних норм щодо містобудування, планування і забудови території передбачається, що відхилення від вимог будівельних норм (у тому числі в частині забезпечення пожежної безпеки та протипожежного захисту) як такі заборонені не будуть, але буде встановлено обмеження щодо можливості їх застосування. На теперішній час складено навіть чи не остаточний проект так званого “червоного” списку відхилень, погодження щодо яких не допускатиметься за жодних умов.
Відповідно, тим, хто наразі займається розробленням архітектурно-планувальних рішень, концепцій забезпечення пожежної безпеки, проектуванням систем протипожежного захисту або шукає підрядників (субпідрядників) для виконання цих робіт, варто бути дуже обережним, аби вся робота не пішла нанівець після офіційного затвердження нових норм.
